X-Message-Number: 2768 From: Trygve Bauge <> Date: Fri, 20 May 1994 05:43:39 +0200 Subject: CRYONICS under fire in Nederland Colorado PLEASE POST THIS IN ALL RELEVANT CONFERENCES AND USER GROUPS! GOVERNMENT BY INTIMIDATION! The mayor and the trustees in the Town of Nederland originally threatened to forcefuly take posession of my grandfather Bredo Morstoel and Al Campbell, thaw both out and cremate them. They were able to intimidate my client David Tate, into removing his friend Al Campbell. I have not been able to reach David Tate the last few days and have no confirmation as to what he has done to Al after he arranged for the latter to be repackaged and shipped out in dry ice from Stapleton last Monday. My understanding is that the still frozen body, was either going to Chicago or to Bio Preservation in Los Angeles. The county health department has come down on our side declaring that the bodies pose no threat to the public health. On Monday the local newspaper took a poll that showed that 68 out of 100 people within the town of Nederland, wants the body's to stay, 30 wants them moved and 2 have no opinion. A total of 100 people were polled out of 1500 residents. (The town by the way has upwards of 100 bodies burried unofficially here and there, and most people don't understand why the trustees are hassling us) 12 people spoke out in our favor before the board of trustees, and no one in the audience spoke out in favor of banning cryonics. Several offered their assistance or to let us store the bodies on their properties just outside the city limits. The board of trustees in the town of Nederland in Boulder Colorado still passed an emergency ordinance immediately outlawing cryonics as a nuissance affecting all zoning classifications. They still permit cemeteries, but only with a permit and are on record as stating that they won't issue such a permit for cryonics. (Needless to say I am not planning upon applying for one either) The vote was 6 to 1, with Bob Howard being the only trustee on our side. They are fining me and my mother $300 a day for not removing my grand father from the dry ice box that we are storing him in. My attorney says the ordinance is unconstitutional, and overbroad and on its face value also outlaws the storage of broccoli and chicken fried steak! and that the town still will have to go to court to get an injunction before they can do anything. I aim at challenging any injunction the whole way to the supreme court if necessary. In the meantime we will be asking for an injunction against the use of the emergency ordinance, If the court supports our argument that no emergency exists, we will file a letter of intent to petition for a refferendum. which will immediately bring about a temporary restraining order preventing the ordinance from taking effect until a refferendum can be held on whether or not it is to take effect. My mother goes to trial on June 13th on trumped up charges of zoning violations (the trustees claim we were running a business in a residental area, while all the contracts and records show that we were running a rational religious venture, the zoning by the way permits businesses run out of private homes), in the mean time townhall has locked my mother out of our house. Our plans to bring in more patients and upgrade to electrical freezers or liquid Nitrogen are on hold pending the outcome of the battle with the town trustees. To better fight the upcoming legal battles I have set up the Boulder Polar Bear Club Auxiliary as a support group to assist me and my mother in our battles with townhall and INS: Membership is a donation of $ 20 or more per year. and I encourage anyone to join!
