There is nothing illegal about removing a brain and fixing it, and it does not 
require a surgeon, only a pathologist. 

Pathologists have done this for many years for _brain donations_ to neuroscience
researchers, and anatomical donation might be one way to set it up.

A next of kin can request autopsy, and can limit the autopsy and direct the 
destination of the organs if it is a voluntary autopsy.

Removal of the brain is one possible part of any autopsy so it is not illegal 
and will not result in any lawsuit if the next of kin requested it.

But autopsies are time-consuming and usu considered non-urgent, so the 
pathologist may choose to do it whenever he/she gets to it, and may charge a 
fee.
