I have spent an enormous amount of time and efforts writing the court, faxing the court and calling the court without getting any straight answers. They have not sent me any court orders either by mail or by fax. Please call the court at 303-441-3750 fax 303-441-4750 and find out specific what the court finds lacking so that I timely can ammend the appeal. On Friday the 3rd of March a clerk finally mentioned to me that they still needed the power of attorney and the filing fee, and I told her that I had wired the money and that I was doing my best to get them a copy of the several year old power of attorney from other sources in Colorado, since all my copies are at the house in Nederland and I don't have any copy here in Oslo. (I was deported with just the clothes on my back, and my mother was permitted to bring a suitcase or two thus all pertinent files are still at the house in Boulder, the INS certainly makes it harder to defend one's rights.) If anyone can assist then that would be welcome. My mother can not afford to hire an attorney, and if the court refuses to appoint an attorney to represent her, refuses to let me represent her and insists that she files the paper work herself, then her mental illness should at least toll her deadline for filing an appeal. But what good does it do to file an appeal when she gets out of the hospital in a few months, if the town cremates my grand father in the mean time, or fines my mother and takes the house for her non compliance with the court order that banned cryonics. Never mind that she couldn't afford a lawyer and was mentally ill and unable to represent herself when she got convicted of having my grand father in cryonic suspension in the first place, and that the Nederland court failed to appoint an attorney to represent her. She didn't even have the wherewithall to read the paperwork served on her in the case and hadn't read this. She had lost all paperwork by the time she got to Norway and I still haven't seen the exact verdict from the Nederland municipal court, but it apparantly ordered her to remove my grand father by March the 6th or the court would cremate him. The latest is that the town will first fine her and take our house, and then cremate my grand father. To steamroll over the mentally ill the way the town of Nederland and their court has done with my mother, does not constitute civilized behavior or a civilized society. What good does it do to have rights when one doesn't have the wherewithall to defend these and the court is of no assistance. My mother is now in a mental hospital here in Oslo, her doctor has in writing made it clear that my mother can not sign any document or take any legal action in her present state. I have faxed the doctors letter to the court twice and they keep losing it or claiming not to have received it, The fax here acknowledged that all the pages went through both times. I have prepared, signed under a power of attorney from my mother and mailed to the 20th district court two appeals. I appealed both the board of zoning adjustments decission and the ruling in Nederland municipal court. The first appeal I even got mother to sign and file in person with the court on december the 5th. And she claims to have paid the filing fee for that appeal. What happened to that appeal? Non of us have heard a word about it from the court! The second appeal I prepared and signed and mailed out to the court and to opposing counsel on February the 16th. And there too I have heard nothing. My mother was to sign, file and pay the filing fee for that appeal too, but her mental illness, alcoholism and deportation prevented her from doing that. Thus I had to wire the filing fee from Norway which I did. I have even mailed and faxed an Amicus Curae "Friend of the court" motion showing justifiable neglect for the delayed paying of the filing fee, and included the statemeent written by my mother's doctor. When I spoke to the court on Friday the 3rd I was told that the court had found one of my appeals lacking and had refused to hear it. I have a right to appeal that and to ammend the appeal, but how can I do that when the court hasn't even bothered to send me the court order or any statement as to what it found lacking or even to let me know that it found anything lacking. My name and address was included with all I filed, and the appeal I filed in February listed my mother's address as identical to mine here in Oslo. She was being deported the next week. But non of us have heard anything. Do I have to appeal to the federal court to get respect for due process? Trygve Please respond as soon as possible. Please contact our neighbors that share the joint driveway with us, and get a copy of the road agreement including the power of attorney that I used when I signed the road agreement. All my copies of the power of attorney is in Nederland thus I have no way of retrieving it and sending it myself. The clerk of the court claimed that they might let me represent my mother if I provide them with that power of attorney. If they just put the appeals on the docket, I have already filed motions asking that they appoint a local attorney to represent my mother and that it be set for a retrial in a less biased court then the one in Nederland where my mother did not get a faire hearing. I have also moved that I be added as a third party defendant, after all I did under power of attorney all the things that the court now wrongfully has convicted my mentally ill mother of. So far the courts have refused to add me as a defendant, and refused to let me represent my mother, The town of Nederland has deliberately gone after my mother as a much weaker victim for their transgressions. But what can you expect of a town that waited with attacking my cryonic venture until I was safely deported, and then immediately jumped on the opportunity to shut us down by focusing their attacks on my pure old mother. Contrary to the erronous press story that went around the world, the two frozen bodies were not discovered after my deportation. More than 100 journalists in the Denver area had received a press release about my cryo[Anic venture 2 months earlier, with all pertinent details about the two bodies. And every step I took in developing the facility had been documented in the cryonic trade journals almost on a monthly basis since we bought the land in 1991 I had even told the local planning commission about my plans back in 1991 when we bought the land. And though they weren't trilled I complied with the zoning law, and they had to pass a post de facto ordinance after I got deported, and to since stretch and ignore older zoning laws in order to outlaw what I had been doing! It is clear that even a mediocre attorney would have been able to win the case for us, however my mother couldn't afford an attorney, the court failed to appoint one, and insisted on putting my mother on trial in spite of she being certified mentally incompetent. So much for justice in the town of Nederland. My mother is unable to appeal the verdict herself. The 20th district court has so far refused to let me represent her and has not given me any clear reason why, and has not sent me any dismissal of my appeals in writing, or in any other way notified me so that I could timely ammend the appeals. If this is justice, then Jefferson was right when he said that the United States is in need of a revolution every 5 years!
