Subject: Freezing living brain as opposed to dead brain

I was having a discussion/argument with a friend. They maintained there 
was only a chance of bringing someone back from brain  death if the 
person was frozen while the brain was alive. I said it made no difference 
(except less damage if a disease destroying the brain & had to wait till 
dead) as same damage done to the brain by freezing process. Also what 
about the legal question (unless allowed to freze a dying person now in 
some States or countries)?
So, (1) Are there some States where legal to freeze a dying person 
before they are legally dead?
(2) What difference in damage to brain if comparing freezing a brain 
while the person is alive to when the person has just been declared 
legally dead?
