Lauderdale, FL, Oct. 7, 1991 -- The Life Extension Foundation (and its officers, Saul Kent and William Faloon) just filed their fifth lawsuit against the U.S. Food And Drug Administration (FDA) in the U.S. District Court in South Florida. Also named as defendants in the suit are the U.S. Department of Health And Human Services and Dexter Lehtinen, U.S. Attorney for the Southern District of Florida. The lawsuit asks the court to grant the plaintiffs a Declaratory Judgment and Injunction prohibiting the defendants from selectively and inappropriately enforcing the Federal Food, Drug and Cosmetic Act "in retaliation and as punishment" for Plaintiffs' exercise of their right to redress against government agencies (as protected by the Constitution of the United States) through the publishing of articles, brochures, caricatures, and advertisements; by giving speeches before Congress and the press; and by appearing on television and radio shows..." This lawsuit was filed because the FDA has been spending millions of taxpayer dollars on a criminal "investigation" to stop plaintiffs from criticizing FDA policies and practices. The Life Extension Foundation has been the FDA's severist critic for the past ten years. The Foundation has documented perjury and violations of the U.S. Constitution by FDA officials, and has shown how FDA incompetence and corruption has caused the needless suffering and premature death of millions of Americans! The FDA has been trying to silence The Foundation with threats of indictment and jailing its leaders, even though the FDA has yet to present a shred of evidence that The Foundation has ever harmed anyone! In fact, The Foundation has donated half a million dollars for scientific research to improve the quality of life for older Americans, and provides invaluable information to its members about the latest biomedical breakthroughs, and the best available methods known to science to prevent and treat the diseases of aging. The Foundation has already won the first of its lawsuits against the FDA. On Oct. 1, 1991, Judge James C. Paine signed a Court Order granting The Life Extension Foundation the return of all its property, which had been seized by the FDA in an illegal raid of The Foundation's premises on Feb. 26, 1987. The Foundation believes that food and dietary supplement companies should have the right to make accurate health claims for their products based upon the findings of scientific studies without prior approval by the FDA! On Aug. 29, 1991, Foundation President Saul Kent testified at a hearing of the FDA Task Force On Dietary Supplements that, because of the FDA's long history of bias against dietary supplements, the authority to regulate dietary supplements should be moved from the FDA to the U.S. Dept. of Agriculture (USDA).
