Hi Rudi,
Glad you're on this now and thanks for the kind words. BTW, I never
figured you'd forgotten, and assumed you were busy. I'm working with a
law firm in Minnesota, who's now investigating the viability of
perpetual trusts in North and South Dakota. Preliminary research
indicates that South Dakota removed the rule against perpetuities in
1983 in law 45-5-8.  However, they have an alternative mechanism that
may implicate a cryonic trust. I also looked at North Dakota and could
not find any rule against perpetuities statute in North Dakota nor could
I find any statute that repealed it. But the common law (non-statutory)
may still be applicable in N.D.  The law firm is going to look for that,
and also will investigate state income tax in N.D. and S.D. as it
relates to trust property.
I will share with you all research and any suggested contract language
they come up with, and will also give it to each of the cryonics
organizations to post on their Web sites.
I think Wisconsin still allows perpetual trusts, too, so you might want
to focus your efforts on that state.
